DECLARATION OF EL FUTURO ES NUESTRO (IT’S OUR FUTURE) REGARDING THE UNION FLOC
On this day, May 1, 2025, we hereby declare THE FORMAL SEPARATION of IT’S OUR FUTURE from the Farm Labor Organizing Committee (FLOC). We also declare the freedom of association of all farmworkers from the corrupt chains of such a union!
HISTORY
As members of the FLOC union for up to 20 years, we have seen the union, under the leadership of Baldemar Velasquez, become corrupt and lose its identity as a union over the last decade. Despite past victories of worker representation and innovative multiparty collective bargaining agreements, in recent years, Velasquez has lost the foundational urgency, priority, and vision of justice for farmworkers.
In May 2021, several FLOC member leaders in North Carolina invited Baldemar Velasquez to increase democracy within the organization, and return to its function and purpose as a union, by addressing the many recurring injustices faced by workers, including violations of labor law, as well as violations of the collective bargaining agreement between FLOC and the North Carolina Growers Association (NCGA). Key grievances included: abuses by supervisors; the lack of enforcement of the seniority and “Active Worker” clauses in the contract; the lack of COVID protections; the false promises of a pension; nepotism among FLOC staff, and financial gain by FLOC leadership at the expense of worker representation. In short, Velasquez and his family were benefiting from the relationship with growers, while the voices of the workers were being silenced.
Baldemar Velasquez responded to worker concerns by dismissing them as minor. Following the May 2021 unsatisfactory confrontation, worker leaders created a caucus within FLOC to fight for the democratization of the union, in hopes that workers could once again have a voice in the organization into which they paid dues and gave time and service.
In 2022 and 2024, FLOC union elections took place in which few dues-paying union members were enfranchised to vote, and in which Velasquez and his slate, Sergio Sanchez, Cruz Diaz Montalvo, Christiana Wagner (Velasquez’s daughter) with the support of growers such as NCGA and Joel Boseman, they ensure that neither election was fair nor democratic. The Department of Labor found violations, however there were no sanctions against Velasquez, and ultimately his fraudulent wins were upheld.
United States laws offer few rights and protections for farmworkers; therefore we take it upon ourselves to stand up and make this declaration against corruption, forced dues, lack of transparency, and nepotism.
WE DECLARE OURSELVES:
AGAINST CORRUPTION – The union receives approximately $300,000 annually from the North Carolina Growers Association (NCGA), an entity that hires thousands of H2A workers, as part of its collective bargaining agreement, hardwon by workers. As part of its obligation as a union of farmworkers, FLOC should be representing and supporting its members. However, instead, FLOC fails to represent its members, fails to address grievances, fails to implement reforms to improve the conditions of H2A workers, and even supports grower interests over worker interests, including supporting wage freezes. This corruption has resulted in a dramatic decline in membership and effectiveness of the union. Currently, less than 1% of the NCGA workforce is affiliated with FLOC; only around 100 of 11,300 workers are union members.
AGAINST FORCED REPRESENTATION AND FORCED DUES PAYMENT – The existing collective bargaining agreement forces all NCGA H2A workers to be represented by FLOC. While we continue to support the rights of workers to organize collectively into unions, FLOC is not a true workers’ union because it advocates for the interests of the NCGA instead of its members. This means that filing grievances about workplace problems – one of the key advantages of a union contract – actually puts FLOC members at a disadvantage and leaves them unprotected, because the union sides with the growers. As a result, dozens of workers are unfairly dismissed, and hundreds of “Active Workers” (who remain in Mexico without being assigned a grower) have not had their seniority honored through 2024. In some cases, workers’ union dues have been deducted even after they resigned, and they are denied information about their own union contract, as well as how to resign from the union.
AGAINST THE LACK OF TRANSPARENCY – The collective bargaining agreement is not readily accessible to members. Since 2016, workers have been kept in the dark; no one knows when the contract expires, what it includes, or how it was negotiated.
AGAINST NEPOTISM – Baldemar Velasquez continues to use union resources to support his family by employing five members of his family: Christiana Wagner, David Flores, Irma Velasquez, and Marty Wagner. He also hires his son-in-law, Aaron Wagner, to work for him. At the same time, the Campaign for Migrant Worker Justice (CMWJ), FLOC’s sister nonprofit organization, includes his brother Rick Velasquez and his son-in-law Jon Curry on the Board.
THEREFORE, ON THIS DAY, WE PUBLICLY DENOUNCE THE CORRUPTION OF FLOC. We demand the resignation of such a corrupt union from the AFL-CIO until its wrongdoing is corrected. We demand a formal financial investigation by the IRS and OLMS. And finally, we urge the community at large to cease all support for FLOC, until dues paying members have a voice in electing union leadership.
Since our founding we have worked collectively and democratically and have already achieved great advancements in NC and will continue to carry on the fight for justice in the fields.
We reiterate our solidarity with all farmworkers who have suffered violations of their rights, whether under abusive growers, lack of labor protections or corrupt unions.

DECLARACIÓN DE EL FUTURO ES NUESTRO ACERCA DEL SINDICATO FLOC
Este día 1 de Mayo, 2025 se declara la RUPTURA DE RELACIÓN EL FUTURO ES NUESTRO del Sindicato Farm labor Organizing Committee, FLOC, Y declaramos la libertad de asociación de todos los trabajadores campesinos libre de las cadenas corruptas de tal sindicato!
HISTORIA
Como trabajadores sindicalizados por hasta 20 años hemos visto el sindicato bajo el liderazgo de Baldemar Velasquez corromperse y perder su identidad como sindicato en la última década. A pesar de las victorias de representación y los innovadores contratos multipartidarios, en los últimos años, A pesar de las victorias pasadas de la representación de los trabajadores y de los innovadores acuerdos colectivos multipartidista, en los últimos años Velasquez perdió la urgencia, fundamentalismo y visión por la justicia de los campesinos.
En Mayo del 2021 varios líderes miembros del sindicato en Carolina del Norte invitaron a Baldemar Velasquez a aumentar la democracia sindical dentro del sindicato y regresar a su función como sindicato, con atender los injusticias recurrentes que enfrentan los trabajadores incluyendo las violaciones de ley, violaciones del contrato colectivo entre FLOC y la Asociación de Rancheros NCGA. Los temas eran los abusos de mayordomos, la falta de aplicación a la cláusula de antigüedad y “trabajadores activos” en el contrato, la falta de protecciones de COVID al igual que las falsas promesas de una pensión; el nepotismo entre el equipo de FLOC, y las ganancias económicas del liderazgo de FLOC a costa de los trabajadores. En corto, Velasquez y su familia estaban beneficiándose de las relaciones con los rancheros, mientras las voces de los trabajadores eran silenciados.
Velasquez contestó, diciendo que nuestras preocupaciones eran pequeñas. Siguiendo la falta de satisfacción del 21 de Mayo, líderes trabajadores crearon un caucus sindical dentro de FLOC para luchar por democratizar el sindicato, con la esperanza que los trabajadores nuevamente tendrían una voz en la organización donde pagaban cuota, tiempo y servicio.
En los años 2022 y 2024 hubieron elecciones donde Velasquez y su planilla, Sergio Sanchez, Cruz Diaz Montalvo, Christian Wagner (hija de Baldemar) se unieron con la NCGA y el ranchero Joel Boseman para asegurar que la elección no fuera justa ni democrática. El departamento Laboral encontró violaciones, pero no hubo sanciones contra Velasqeuz y finalmente sus victorias fraudulentas se mantuvieron.
Las Leyes de Estados Unidos ofrecen pocos derechos y protecciones para trabajadores agrícolas, por eso solo nosotros nos tenemos que levantar y hacer esta declaración contra la corrupción, las cuotas forzadas, la falta de transparencia, y el nepotismo.
NOSOTROS NOS DECLARAMOS:
CONTRA LA CORRUPCIÓN – El sindicato recibe aproximadamente $300,000 al año de parte de la North Carolina Growers Association, entidad que contrata a miles de trabajadores H2A bajo el contrato colectivo, ganado por los trabajadores. Como parte de su obligación como sindicato de campesinos, FLOC debería estar apoyando y representando a sus afiliados. De lo contrario, FLOC no representa a los miembros, fracasa en atender las quejas, fracasa en implementar reformas para mejorar las condiciones laborales de los trabajadores H2A e incluso apoya los intereses de los rancheros antes de los intereses de trabajadores, incluyendo el apoyo a la congelación de sueldos. Esta corrupción ha resultado en una declinación dramática de membresía y efectividad del sindicato. Actualmente menos de 1% de la fuerza laboral de la NCGA sea sindicalizada, en total aproximadamente 100 trabajadores de 11,300 son afiliados al sindicato.
CONTRA LA REPRESENTACIÓN FORZADA Y PAGO DE CUOTA FORZADO – El contrato colectivo existente forza a todos los trabajadores de la NCGA ser representado por FLOC, quien aboga por el interés de la NCGA. Mientras que apoyamos el derecho de los trabajadores de organizar colectivamente en sindicatos, FLOC no es un sindicato real de trabajadores, porque aboga por los intereses de la NCGA en lugar de sus afiliados. Esto quiere decir que meter quejas sobre los problemas – una de las ventajas de un contrato sindical – en realidad pone a los miembros de FLOC en una desventaja y los deja desprotegidos ya que el sindicato toma la postura de los rancheros. Como resultado, docenas de trabajadores son despedidos injustamente y cientos de trabajadores activos (sin patrón) no se les respetó su antigüedad en el 2024. En algunos casos trabajadores se les descuenta la cuota sindical aun después de renunciar y se les niega información del contrato al igual de como renunciar.
CONTRA LA FALTA DE TRANSPARENCIA – El contrato colectivo no es accesible para ningún trabajador. Nadie sabe cuando se vence, que incluye ni cómo se negoció desde 2016.
CONTRA EL NEPOTISMO – Baldemar Velasquez sigue usando los recursos del sindicato para mantener a su familia dándole trabajo a 5 miembros de su familia; Christiana wagner, David Flores, Irma Velasquez, Marty Wagner, y contrata la compañía donde su yerno, Aaron Wagner trabaja, al mismo tiempo en Campaign for Migrant worker Justice (CMWJ), la organización hermana de FLOC, tiene a su hermano Rick Velasquez, su yerno Jon Curry y otros en la mesa directiva.
POR ESTO, EN ESTE DIA DENUNCIAMOS PÚBLICAMENTE LA CORRUPCIÓN DE FLOC. Exigimos la desafiliación de tal sindicato corrupto de la AFL-CIO hasta que se corrijan los males. Exigimos una investigación formal de sus finanzas por el IRS y OLMS. Y le pedimos a la comunidad general que ponga un alto al apoyo de FLOC, hasta que los afiliados tengan voz en la elección de sus líderes.
Desde que nos fundamos hemos trabajado colectivamente y democráticamente con algunos logros y avances en Carolina del Norte y continuaremos con la lucha por la justicia en los campos.
Reiteramos nuestra solidaridad a todos los trabajadores de campo que han sufrido alguna violacoin dentro de rancheros abusivos, falta de protecciones o sindicatos corruptos.
